In January 2018, Naqibullah Mehsud from South Waziristan was killed along with three of his associates in a police encounter in Karachi. According to the police, he belonged to a terrorist organization namely ISIS or Lashkar Jhangvi.
Naqeebullah's family and other social circles expressed concern over the police encounter, and in January 2019, Karachi's Anti-Terrorism Court dropped terrorism charges against Naqeebullah on the grounds that the victim's social media profile showed He was an art-loving and model-loving young man and that no weapon was found in his possession.
But on January 23, 2023, the court acquitted Rao Anwar and his other associates saying that the police encounter was fake but the prosecution could not prove that the accused were present at the spot. So, on the basis of lack of evidence, the accused were honorably acquitted. But then who did this murder? If the police encounter was fake and it was a murder, who would be the murderer?
This is not the first case of honorable release of high-profile "accused" on lack of evidence in Pakistan. In June 2017, a traffic policeman named Inayatullah was run over by a car in Quetta's GPO Chowk. From the CCTV footage of the incident, it was found that the vehicle belongs to Majeed Khan Achakzai, Member of Provincial Assembly of Balochistan. Majeed Khan Achakzai was also arrested and the case continued in court. But the subsequent court proceedings revealed that the prosecution could not prove that the vehicle was driven by Majeed Achakzai and this MLA was also acquitted in September 2020 on the basis of lack of evidence. The vehicle may be stolen and there is an FIR, or it may be that someone else is driving the vehicle, etc.
In the same way, Mustafa Kanjo, son of Siddique Kanjo, was also released by the court due to lack of evidence, while his car had an accident. In his altercation, shots were fired and a young orphan named Zain was killed.
Shahzeb Khan murder case, Sahiwal tragedy and dozens of other cases in which the accused are released due to lack of evidence or are not caught at all. Court, prosecution, people, rulers and other people know how the evidence was not? The court and judge also decide on the basis of documents, evidence and witnesses, but where do the killers or criminals disappear after the crime? Why don't they leave evidence of what they did? Although the world's most expert intelligence agencies also leave some evidence against themselves.
Let's say the accused was released, but the crime has been committed, then who did the murder? Will the victim himself get up for this? If the "accused" is not a criminal, whose job is to find the criminal? Is this the work of the relatives and the deceased? What are the judiciary, police and other institutions for? If the witnesses run away, who scares them? Whose responsibility is it to protect from fear if someone threatens? And if the plaintiffs reconcile, why do they do it? If the judiciary and the police, despite being so empowered, cannot withstand this pressure, then the common citizen will forget that it is better to shed blood than to burn it.
Some time ago today, a columnist revealed in his column that he surveyed a prison through his jailer friend and interviewed the inmates. These prisoners were bound for various crimes ranging from pickpocketing to theft and adultery to murder. The purpose of his survey was probably to know the conditions of the prisoners, but he concluded that crime in Pakistan does not affect the rich and noble, but only the poor and weak, whether they are potters, cobblers, barbers, weavers or those around them. People do, while no big landowner, big businessman, big government official, politician or Towana, Vito, Laghari, Mazari, Zardari etc. do.
These figures are only falsely accused by their opponents out of jealousy of their position, power and money. His political opponents use it to win elections. And all their audios and videos are deepfake. Therefore, they stay in jail for some time, where they are provided with slightly better facilities than other prisoners, where they are provided with the best doctor for treatment and sometimes the hospital room is declared as a prison. . And in the end, while making a sign of victory while chanting "Justice has prevailed" or "Courts do justice" or "Allah has disgraced the opponents", these people would be acquitted on the basis of no evidence. are
This situation of the justice system and legal framework prove that unless the law is applied equally to all, rich and poor, this cycle of acquittal of influential people on "no evidence" will never end.
